Hit by a Drunk drivers

I settled wayyy to soon for a broken femur, back in 1986. I think her insurance company, bought off, or made a deal with my lawyer. I was young and naive. Still have major knee problems, from being in traction for 7 weeks. Don't be in any hurry to settle, especially with a broken bone.

"After wreck drunk got out of his car and walked into mini-mart to get a drink,"
That's the typical CYA for DWI. Suck down as much alcohol as possible after the accident and before cops arrive. Breath-a-lizer results are altered and by the time blood can be drawn, there's no proof of WHEN the alcohol was ingested.

The mom of my best friend growing up was killed by a drunk who ran a red light and t-boned her. He tried to restart his car, but since the whole front end was jammed into the engine, he couldn't start it. So what did he do? The loser walked back to the bar he'd come from and resumed drinking.

If you drank in public, there's a thing called witnesses. Bartenders and waitresses can render that strategy useless.

Recently, in metro Detroit, a career drunk went to a birthday party. It was in a building closer to her home than my machine shed is to mine. First she backed out of her parking spot and hit her neighbor's truck. Then she shifted into forward, drove thru the side of the building the party was in, and killed a brother and sister. Her defense was that she only had one glass of wine at lunch. One problem with that testimony. She had been drinking all morning and was busted by her own home security camera footage. I hope she rots. 66 years old, I think -- may she never taste freedom again. Found guilty on 2 counts of second degree murder.

I guess this all assumes you were on the shoulder, or further off the road........instead of in the middle of the road assuming everyone would see ya.

If you were anywhere near traffic flow, a good lawyer would argue contributory negligence. You have a duty to mitigate your injuries, or responsibility. Is what it is. Law..........

Edit.............I'm assuming this was litigated(?)

Ouch, a shattered fibula is rough, wishing you a speedy recovery, man. And taking out a classic Ford 340B? That driver is an absolute menace. Six thousand five hundred for a well-maintained tractor like that is ridiculous. The insurance company is counting on you taking the easy money.

Forget online valuation tools; they never account for the real resale value of older, well-kept equipment. Find two or three current private sales or auction results for a 340B in similar condition from the last year, that’s your proof.

Because the at-fault driver was intoxicated, they’re looking at a serious criminal charge, likely felony OWI since you were injured. This complicates things massively.

If I were you, I’d want to make sure the driver who did this is held fully accountable on the criminal side too. Someone who really understands the gravity of the OWI offense in Indiana is the team at Wruble Law. You need their expertise on the criminal angle to ensure maximum pressure.

Hopefully things worked out for Rick.

Recently I was hit by a drunk driver.
I was attempting to drive my Ford 340B. Tractor home from my shop, which is about three blocks. I stopped to adjust my back blade. And was standing behind the tractor in front of the back blade, when she hit me. It totaled her car and I suffered a shattered fibula. I've had this tractor four, approximately ten years and love it. Her insurance company, what's the total? The tractor and give me sixty five hundred. How do I find the tractor value? Is my question? It's in great shape and ran flawlessly.
My brother got hit and messed up his AC 180 pretty good. He made a list of what was broken and got the AGCO dealer to work up an estimate of what it would cost to fix it. Don’t recall the total but it was way more than a good 180 was worth, the insurance company paid it.

Was in a rear end wreck 3 years ago didn't want to get an attorney, so we tried to handle it ourselves paperwork was so complicated had to finally get an attorney to do it didn't like the doctors they had me go to. If there is another time the first call, I make is to a lawer
