Hit by a Drunk drivers

I settled wayyy to soon for a broken femur, back in 1986. I think her insurance company, bought off, or made a deal with my lawyer. I was young and naive. Still have major knee problems, from being in traction for 7 weeks. Don't be in any hurry to settle, especially with a broken bone.

That's the typical CYA for DWI. Suck down as much alcohol as possible after the accident and before cops arrive. Breath-a-lizer results are altered and by the time blood can be drawn, there's no proof of WHEN the alcohol was ingested.

The mom of my best friend growing up was killed by a drunk who ran a red light and t-boned her. He tried to restart his car, but since the whole front end was jammed into the engine, he couldn't start it. So what did he do? The loser walked back to the bar he'd come from and resumed drinking.

If you drank in public, there's a thing called witnesses. Bartenders and waitresses can render that strategy useless.

Recently, in metro Detroit, a career drunk went to a birthday party. It was in a building closer to her home than my machine shed is to mine. First she backed out of her parking spot and hit her neighbor's truck. Then she shifted into forward, drove thru the side of the building the party was in, and killed a brother and sister. Her defense was that she only had one glass of wine at lunch. One problem with that testimony. She had been drinking all morning and was busted by her own home security camera footage. I hope she rots. 66 years old, I think -- may she never taste freedom again. Found guilty on 2 counts of second degree murder.
 
I guess this all assumes you were on the shoulder, or further off the road........instead of in the middle of the road assuming everyone would see ya.

If you were anywhere near traffic flow, a good lawyer would argue contributory negligence. You have a duty to mitigate your injuries, or responsibility. Is what it is. Law..........
