Nebraska Sale Again

I was just wondering - if Kruse goes ahead and has the sale, what guarantee does a person have that some court order later on won't "repossess" anything sold at the sale.

Could it be like the poor guy that unknowingly buys some stolen equipment and then has to give it up later when the law and rightful owner come after it??

Or will everyone just be filing off the serial numbers as it gets loaded out?? ha...

The link below is a link to the sale. There is an admission fee of 10 bucks per person. This sale will draw people from around the world with the cheap dollar. There is nothing to contest any ownership of the tractors that run.
Nothing to contest the tractor parts that do not run. Nothing to contest.

Truly a sad state of affairs. If you have not read the Aumann Auction statement it is worth your while. Deano totally messed over the tractor collecting world in March now he is even buying up entire real estate properties to get to us good ole' tractor boys. We must be a lot dumber than than our counterparts in the car collecting business!! I know I am not spending $4.00 gas to drive out there just to line his tacky slimy pockets!! He got me once; he won't get me again!!

I am from Indiana and truly sorry to say he lives in the same state!!

Kruse tries to run tractor auctions like his car auctions with parking fees,bidder number fees,a buyers premium,etc.He had a sale in ohio a few years ago and hardly anyone showed up.The ring men wore tuxedos.People were astounded at some of the opening bids he asked for.An old farmall f12 was in the auction.He was trying to get 12000
for it.A few weeks after the auction everything was still setting there.

i can understand a auction.... but WTF would i want to pay $10 just to get in to then spend money to buy ? i know i couldnt compete against some of the buyers that will be there but i did want to go look & take my digital to snap alot of pics of things i dont see every day but now it costs me gas & then another $10 ? well there goes that vacation as ill go to AZ again this next winter instead now......not given them free money they dont deserve

I don't care if the sale was across the road from me, I will not go to a sale and give 10% for the right to buy, not to mention the $20 catalog or the $10 admission if you don't buy the catalog. At some point, ya just got to tell the greedy @######@ to keep their junk. Interesting to see how the lawsuits pan out.

Now thats a bit nuts .. I won't and refuse to go pay money anywhere. Just so I have a right to spend my money there.....they can kiss this ole boy's Buttttttt as I see it. I won't and have not gone to an auction where I need to pay to park either.
Run across that at an open auction as I seen it up in Missouri. So when I drove up and they wanted a dollar to park my car in this field. ha ha I started laughing and said.. what! and you want me to buy something too! ha ha I drove away. laughing.

going to be a nice auction OR Was..... till its bend over customers $10 to get in the gate O' & no Vaseline allowed we like it hard, If your company was smart instead of shafting us at gate to get something we could use that $10 on & yet we already gotta pay the high gas cost to get there U should give us bidders the $10 just for coming to your auction its a never to see again tractors Some people are just greedy (krus ) Way to ruin another great sale for the collectors & just spectators .. i for one wont waste the $ 10 for his pocket for doing nothing for me

Do any of you remember back in the 1960's when Dean kruse worked for an automobile courier. He was transporting a brief case with close to a million dollars in it and managed to loose it in transport on an airplane.I remember it was in the news here.They never did find the money.He later lost his
auctioneers lisense in indiana for being dishonest.He later got it back.Then a few years ago he sells his auction company to ebay.They found out he inflated the books to make it look more profitable than it was.He then bought it back to avoid a lawsuit.

IMPORTANT ANNOUNCEMENT

On September 11, 2007, Aumann Auctions contracted with Joan Phillips to sell her late husband’s collection of approximately 2,500 antique & collectible tractors, parts, trucks, toys and many other items. We contracted this auction in good faith and immediately began advertising and promoting the auction as instructed by the sellers.

However, Mrs. Phillips later informed Aumann Auctions that she had sold the entire operation with all of the assets and real estate to one buyer, and that she must terminate the auction contracts with Aumann Auctions. After considering all of the circumstances and in light of this advisement, we began litigation in the United States District Court for the District of Nebraska alleging breach of contract by Mrs. Phillips and we are vigorously pursuing that lawsuit. Unfortunately, due to the above events, it appears we will not be conducting the Phillips auction.

We want to thank all of the collectors and interested parties that have been so supportive and helpful during these last few months.

While we personally strive to conduct business in an upfront, ethical and transparent manner, this type of incident is one we have never had to deal with. We apologize to our customers for any inconvenience this has caused you. We have had hundreds of inquiries for the auction already and will try to contact all of those personally.

It is our opinion that the facts of this transaction will present itself to the collecting community soon. Please see our other great auctions for 2008! We look forward to seeing you at one of them.

From what I've been able to gather, the ownership of the tractors, etc., has never been in dispute. Aumann apparently had a contract to auction them off for the family, and this contract is what the lawsuit is about. I would think the best Aumann could hope for is to recover his out of pocket costs and the lost profit he would have made by conducting the auction, plus maybe some punitive damages. This is a breach of contract issue, not a who owns what issue.

Still debating if I want to go.

I would carry a petition around the world for signatures if I had someplace to give it when it was completed. Since he is a renegade auctioneer, there is no organization or policy board to control such unethical actions.

Just us good ole boys throwing him our money.

He would sell his mother and charge her to watch!!

If all this is true about Kruse, he might have conned the owner of the equipment. I would think that if Aumanns had a signed contract, they are entitled to the commisions they would have received. I'm not a lawyer but I think in a breach of contract, the plaintiff can sue for any monies that they would have received had the contract not been broken. Dave

More then likely there will not be an auction of any of these items until this case has come to some sort of settlement in the courts. I am sure that there are some clauses in the Aumanns contracts that prevent the sale of the contracted items outside of their auction and more legal mumbo jumbo then any of us are aware of. Not only that but if Kruse knowingly bought items that he knew were under contract to a fellow auction house I would be surprised if there werent some legal ramifications that can be placed upon his bond!

I am quite sure that it will make for some interesting depositions!

No, I ain't going. I don't care if they give the tractors away. It does not seem ethical to me for another auction house to take a sale knowing full well that it had been previously contracted. It's all about money and Kruse ain't getting ANY of mine.

Heck, I don't even like a 3% buyer's premium, let alone 10%. It always occurs to me that the seller should pay the auctioneer, not the buyer. Sounds like the Barrett-Jackson car auctions to me. It would have to be some rare, pristine tractors to bring that kind of money.

I looked over the inventory and didn't find anything I am interested in. No Olie 77 LP's or Ford LP's. Don't have any accomidations and don't want to pay the fee's to get in.

Not betting that there will be a sale this April anyway. The court's move slower than that if anyone wants to slow it down.

Will be interesting to see how it all comes out in the wash.

I had been planning on going but after reading about all the legal struggles and issues in a couple of threads last week, I have decided not too. Also there is no way I am driving that far, then have to pay $10 to get in and then a 10% or 15% buyers premium. That can add up to a lot of extra money in a hurry. I also wouldn't be surprised if one of the involved parties obtains a court order halting the sale of all goods until the legal battles are resolved.

I also just looked over the inventory, and didn't really see anything that caught my eye. Most of the tractors and implements and whatnot have obviously been stored outside for sometime, and are not in the greatest of shape.

If our justice system works like it should Kruse can conduct the auction and Aumann can collect the profits. But when has our system really been fair? Sounds like a long legal battle.Just my 5 cents worth.

If you read a little farther, you can join the Kruse prefered customer program for $250.00 a year. Then you do not pay the buyers premium, or admission, and you get a 500 page book with all his auction results. This guy is a joke?, for lack of other words. I guess he things we should feel like it is a privaledge to go to his auctions. He also sounds like the type to have shills in the audience running up bids.

That 10% buyers fee bugs me too. As far as paying to get in wellllll, if you went to a car or boat or tractor show, you wouldn't expect to get in for free. What does 2 Cly. charge for their shows by now? 2500 tractors all in one spot would make for an interesting tour stop if you were going some where and you probably would dig out the money no questions asked. I suppose printing up catalogs isn't cheap either depending how its done up. Ever buy a program at a sporting event? Just a couple of thoughts, don't get mad at me for bringing it up.

That is known as a business expense just like advertising.

The preferred buyer program used to only cost $200 but a couple of unknown bidders ran the price up to $250.00!

If you were not in Yuma you can not appreciate the open, blatant thievery going on!!! They did not have shills in the audience, the brothers just stood up front at the auction block and ran people up (Personally experienced the goose grease first hand) When it is midnight and you are buying $100,000 tractors who can find that the phantom bidder that is giving that nod 600 feet away? It was truly a joke and this rodeo will be no better. He will get you going in, get while you are there and get you when you leave. Take an extra part of underwear - you will need them!!!

Experienced that first hand! Skip, you better hang on to your wallet in one hand and your pants with the other hand and I promise you will still buy something!!! Especially if you are the only one in the field!! And you will have bid five times before you checked what hand was holding what!!!
