starter problem

I recently bought a rebuilt starter and I am having problems . The starter spins on the bench(no load) at a high rpm. When I put the starter in the tractor it just ratchets and does not turn the motor over. I put in a new clutch and the fly wheel teeth are in very good shape, the pin is in place holding the bendix. The motor turns when turning the fan as does the fly wheel. The bendix is in the starting position,spun down toward starter. I cannot get it back in place. Does this cause a problem? Or do I have a defective new bendix on this rebuilt starter??
 
There was one more thing that I left out when I told you the possibilities that I could see yesterday.

It is possible for the ring gear to slip on the flywheel. I had mine tacked in about 4 places when I had it replaced.

The bendix being engaged shouldn't hurt anything that way as long as you can get the starter back in the hole and mounted.

And I guess you could also have a defective new bendix.
 
You can usually spin the bendix with a wire wheel brush on a bench grinder in the right direction fast enough to get it drop back.
