Explain this wreck

Indiana does not have any silly law about yielding to people passing on the left during a left hand turn. My uncle was hit by an impatient driver passing on the left from 4 cars back as he made a legal left hand turn from a 2 lane road to another 2 lane. Passing driver was sited, and his insurance got to buy my uncle's van and pay medical expenses.

A school bus passing is ridiculous on a 2 lane is an unnecessary risk.
yeah i looked it up too. not legal here. not sure if they didn't changed the passing on the right. was only if you didn't leave pavement (no passing on dirt berm) but there is statute to not use berm for traveling. I consider any time driving forward to be traveling.
 
Going back to when I was in high school and taking driver ed, I was told that the vehicle that initiates a passing maneuver is required to perform that maneuver SAFELY. I was also taught that if anything happens during that maneuver, it is the fault of the passing vehicle, not the vehicle being passed. This was reinforced when I took classes for getting a CDL so long ago.


I cannot even comprehend why anybody would think differently.
it seems like 99% of what i learned in my HS driver's ed has either been forgotten by the rest of the world or banned.

like my instructor said, when you are driving, you have ONE job and ONE JOB ONLY. and no, it's not "be sure to check facebook repeatedly."
 
Maybe I'm beating a dead horse, but either driver could have prevented this accident. The bus driver must have been overtaking the tractor at a fairly high speed and passed in what was technically a no-passing zone, even if it wasn't marked as such. The tractor operator failed to check for overtaking traffic and probably failed to use hand signals. There are lessons to be learned here. In the end, the goal is not to be in the right; it is to not maim or kill anyone, including yourself.

Yep. I was taught in a long ago hs drivers ed that the driver crossing or changing lanes is responsible for assuring it is safe to do so. Both of those drivers fit that description
