Lending equipment

Well I went to get my rotory pull mower and realized that I lend it out last fall to a neighbor. I had sold him an IH 300 which it fit behind and he was going to do some mowing. Of course I want go get it but here is the issue. He died in Dec. If I go their now to get it, some one may think I'm steeling it. No ones around the house at all and I really don't know who to contact. Its not worth much and I just wonder if I should just mark it up to stupid. I don't have a bill of sale showing that its mine. What do you guys think?
 
Gotta be a family member somewhere you could talk to about it isnt there ? If it is rightfully yours I would gently pursue it if it were me.
 
If you know any law enforcement, talk w/them, maybe they would go with you to retrieve the mower. Have you told anyone else about lending the mower, they could verify your story/ownership. It doesn't hurt to know some law-dogs for just such a situation as yours; good luck in getting your mower back.
 
Is anyone looking after his property?

If no one is around, no close family or friends know what he has, you know the situation.
You know what is right go ahead cause you know whats right he would feel bad cause he did not return it once you get it he can rest in peace
 
Use the KISS theory. Just go get it. Possession is 9/10ths of the law. Once you have it, it is up to them to prove that it is theirs.If they happen to contact you about it tell them the truth. You must have some sort of ownership doc. Someone saw it at your place, wife knew of it, where/when/ how you acquired it?
Do NOT go to the law!
Just don't park it in your front yard.
 
If it was mine I would just go get it. Get in an get out. If it is righfully yours, it should not bother you. Be glad there is no one there to say "Prove it is yours"
 

Here in my town I would just go get it, because everyone knows everyone else, and if an unknowing person called the cops, the cops would probably say go ahead, we know where you live if anyone asks. You know your local situation better than anyone here.
 
My Dad had a drill stored in our neighbors barn. At my Dads funeral, this neighbor and I were talking, and the subject of the drill came up. It seemed that Dad had sold the drill to someone, but neighbor did not know to whom.
Told my neighbor, that if anyone showed up to get it, they need to show proof, ie., bill of sale. He just laughed, said your Dad sold it 3 years ago, doubt anyone is coming after it.
So I went and got the drill and told my neighbor that if anyone shows up now looking for the drill, to send them to the cemetery to talk to my Dad....because it's my drill now!
I've had the drill 2 years now, and still no one has tried to claim it.
 
I"d just go get it. Chances are no one will even EVER notice it being gone. Reminds of the time a few years ago I borrowed a New Holland 56 hay rake from my neighbor when mine broke down. It was an "extra" he had sitting around. I took it back when I was done with it the next day. Two years went by and he happened to ask me about it. He had never even noticed that it had been returned and was right back where it was originally.
 
I'd just go get it. I contacted an old fellow who had a JD 1010 about a set of cultivators. He said the tractor had been sold & the land & barn had been sold years ago & the cultivators were in the barn the last time he saw them. He couldn't sell them to me because the barn didn't belong to him any longer but they were in the barn the last time he saw them. I took the hint, they are in my barn now.
