OT- Loose Horses (Long)

There is a man up the street with 4 horses (3 Clydesdales, and 1 "regular size") that are constantly getting out and roaming around. They usually end up on my property, which I don't really care about, as they eat grass which I would otherwise have to mow... They are a serious hazard to traffic though.

The owner seems to be a knucklehead, since he has done nothing to repair his sorry fence, which is the cause of the problem.

There have been many reports made to the Sheriff's Office, and they have written citations to the owner for "Animal Neglect".
According to them, this is the limit of what they can do.

I have talked to him, as have all of the neighbors, and there has been no change. I even called a horse rescue group, but they can't take them.

Has anyone had a similar problem?
Any reccomendations?

BTW- The horses are on my property right now. I locked the gate, called the Sheriff. Told them that the owner will have to be accompanied by a deputy before I will let him on my property.

Here is how I would handle it. I would approach the horse owner and ask him to schedule an afternoon and provide supplies to fix his fence, with your bargain being that yourself and the neighbors would all show up and help mend his fences up to standard for a couple hours.

If the fella cannot accept that simple bargain, then sternly inform him the neighbors and yourself will simply go after him legally.

got a similar problem at one of my farms. neighbor on a farmette has 2 horses, chickens, guinie hens, peacocks and 2 pigmy pigs. critters are always at my place. horses always get out. the horses got in my corn and ate and knocked down 2-3 rows around the buildings. pigs run loose, rooting up all over. talked to them numerous times about it, goes in one ear and out the other. i'm at a loss, try to be nice about it, but patience is wearing thin

Is the fence between you and him if so its half your problem also any fence between him and a neighbor.
My friend had a problem like this last year his cows would get over to the neighbors and she would just complain about it. she cattle on her side lso but refused to help any with the common fence it was all his problem because her cows didn't get out that we know of.

Most states have laws regarding "strays" (or "estrays", as they are legally called), and the round-up of same. Owner can eventually get them back, but not without considerable red tape and expense (storage, hauling to an auction yard, etc., etc.) That might get his attention.

I can tell you that in florida, that happens a few times.. then the police confiscate the animals and place them with a rescue. You usually see 2-3 stories about it a year in the local paper.. etc.

The horse owner's land is approx. 1 mile from my property. (no common fence)
The containment for these animals consists of 1 strand of electric wire held up by plastic posts that you push into the ground.

The animals get out when this fence fails, (beside the road) then they walk down the road 3/4 mile, turn the corner, and walk through my gate.

I know i could keep my gate closed, but then they would continue down the road, restricted by mine and the neighbors good fences, until they reached a busy highway.

Maybe he's not aware that he is liable for any damage these animals cause. He probably never had anyone tell him he could be working the rest of his life to support someone badly injured in an auto accident with his horse especially after many warnings....

we had a cow get loose once,got hit by a car, we were held liable.neighbor had a horse get loose,got killed by a car,driver had to pay for the horse even though the horse ran into the path of the car.go figure seems the horse wasnt considered livestock.maybe im just a little bitter because we had to pay for the car damages.

I take it that you are located back east or in the mid west. Areas that do not have open range laws as there are in Arizona and many of the western states. Here livestock have the right of way in all open range areas which is most of the state. I live 1and 1/2 miles from Marana, AZ and all of the land around me is open range and close to 2/3 of the town of Manara is open range. If you want to keep livestock out of your property you are responsible for fencing your property. Unlawful confinement of someones livestock is a felony. If you hit livestock in an open range area you pay for the animal and all of the offspring it may of had. People have been trying to change the laws all the time but they never seem to get anywhere. Ranching and farming in this area still have political pull.
