That when you get a trespasser and can even get the license number the cops can not find them. Had some one drive down my mile long drive way this morning and wake me up. Yell at them to stop and they floored it so I knew they where up to no good. Got there license number and called the cops. Shoot they even had a realster sign on the side of the truck but still the cop could not find them. This is not the first time this guy was here and it was opening morning of turkey hunting so the guy seemed to be road hunting. Next time I might just jump in my car or truck and block them in and call 911.
 
If I lived close to you, I'd put a big yard sale sign at the end of your driveway and make you a people person.............
 
The problem you get into is called criminal confinement. Every state has it and it simply means you can hold hold a person against their will. If they want to speed off, they have that right. Unless you have a set of red and blues, you can not detain them. You go straight to jail if you do.
 
I remember a few years ago down in Texas where a rancher whom got tired of illegals trapsing through his property every day, tired of stuff coming up missing, and right down the line fed up, pulled a gun on 3 of them, held them there until the law showed up to take them into custody, but by the time it all snaked and slithered through the court system, the judge awarded the 3 illegals the fella's ranch for holding them prisoners.

Illegals aside, I understand how you feel, I do, and I understand you wanting to do the right thing, I do. Problem is, this world is now upside down where good is bad, bad is good, victims are now the predators, and the predators are now the victims.

Be careful old. As far as I'm concerned, that's your property, and I know how you love your property, and I'd hate to see some goofball give your property out to someone else to enjoy, while you make payments on it for them. There are better ways to get even.

I've heard many stories of people getting caught in the act and they hold the person until the cops arrive. Haven't heard of anyone being put in jail for holding someone for maybe an hour at the most, after they were caught red handed. If that's wrong, they really need to change the laws. I'm not talking torturing, just keeping them there till the authorities arrive. Dave
 
A few years ago I saw a car stop just down from my house and shine a spotlight out into my field. Then I heard a shot. POACHERS! I jumped into my truck and was chasing them down the road at high speeds, when all at once it hit me. THEY HAVE A GUN!, and I don't! I turned around and went home.
 
In Ohio we have citizens arrest, BUT, you'd better be sure there was an illegal act committed before you execute thse powers on someone. Those guys could just say they were lost, then you'd most likely be in the wrong for detaining them. Just my thoughts, Keith
 

OLD; had the same kind of problem few years ago,fixed my problem the old fashioned way,caught the guy and beat his azz then i got arrested, bailed out 3 days later, then i went hunting him, he sort of came up missing, don't know what happened to him. me one mean old b#s&ta#d!
 
Local situation. Landowner held trespasser for police. he turned out to be a sleezy rent - a cop (private det). kept the farmer tied up in court for over 4 years. got nothing out of it, but cost the farmer lots in lawyer exp and grief
 
In my area, the cops will not enforce trespass laws and do not want to be called for such infractions.

It makes no difference whether you have the license.

Morning Old, over the years we had a lot of problems with trespassers. We had fence cut, tractors and equipment damaged, etc. We had the signs up around the property lines and trust me when I say this, unless they are caught in the act of doing something other then just being on your land the law doesn't want to deal with it because it's just a warning first time then a little fine if anything. "BUT" "DONT" do anything to them because then the law wants your A$$ ! Been there, done that, got the T-shirt. As one of the other post said things are bass-akwards. GRRRRRRRR
 
Well, Old, if it was me I would look in the yellow pages and find the ad with a logo like on the sign on the truck. Then I'd call there and ask if someone driving a truck like you saw "lost something out your way" without being real specific. Word gets around quickly in a small office like that.
 
I did in fact call that office last night around 11:30 and got an answer instead of a machine. Lady answered the phone and told me after I had talk for a few minute I had woke her up. She did not seem to happy with what I told her so maybe the guy will get a chewing out for being where he should not have been. Oh and I did use a few colorful words when I told her I didn't ever want to see that truck on my place ever again. And this was not the first time he has driven in on me
 
If he was road hunting, the thing to remember is that he has a gun and is not respectful of others. While you could make some trouble, it is far more likely that you will find trouble for yourself.

It is annoying, but not worth the trouble you can get into.

If you can't stomache people comming up your drive, then you need a gate at the end.

Honestly, that is hardly the crime of the century. Try to keep things in perspective.
 
"Up to no good" isn't a crime, so cops probably weren't too interested. Would think if it had a realtor sign, you could probably run it down yourself.

Most law enforcement agencies are short of money and understaffed now, so they're not much interested unless an actual crime has been committed. Local apartment complexes call the cops to come and arrest drug dealers, and are told they can't, because the jail is already full. Kind of a sad state of affairs.
 
It's one thing to drive in by mistake and if some one asks you to stop then you should and tell the person what happened just like if you make a mistake dialing the phone and get a wrong number you should tell them your sorry and then hang up not just hang up. But I also know this guy wasn't there by mistake he knew what is here and knew he was in the wrong place
 
You should probably have filed a trespassing report with the police and let them worry about finding them later if you wish to pursue it. However it would probably be difficult to prove in court that you had the right vehicle license information.
 
Needs to be specifically marked "No Trespassing" for there to be a crime committed. Its not a crime to be on "private" property, unless you've either been told to leave and refuse, or you've gone past a "No Trespassing" sign.
 
If you read the thread, greenbeanman, he TRIED. The cops conveniently could not track down the license.

What I want to know is, why weren't any of these atrocious "criminal's rights" abolished by the GOP when they had SIX YEARS of carte blanche to manipulate the nation's laws?

I thought criminal's rights were a abundant thing and putting the conservatives in office was supposed to make everything right.

Give "trespassers will be shot" some teeth and the crime rate will go down after a couple of would-be perpetrators get sent home with mouthfuls of buckshot.
 
I agree with Mike. In this state you need to have a "no trespassing" sign on it. Just marking it "private" means nothing except that the Post Office won't deliver on it and the county won't maintain it.

I like it, but I'm sure it doesn't do any good.

Maybe we need bilingual "no trespassing" signs?
Who ever started all that bilingual sign cr** anyways???

Well the way this guy acted it probably would have been a 911 call because he probably would have tried to push what ever I blocked my road with out of the way
 
Years ago in the upper midwest I had lots of problems w/ trespassers . I had a trick that worked for me several times . Just went to the P. U. or car that was parked on my land and took all the valve cores out. Laid them rite near the flat tire. Then called the game warden . Worked everytime & I was within my rites as they were trespassing.
 
Ya if they where parked I would have done the roofing nail trick but they where not parked so I could not do things like that. They where road hunting so they did not stop they just drove around on my place
 
old, I'd get to know a few local cops and deputies at the local diner and give them some hunting rights and you may be able to have them run some tag numbers through BMV and they also kinda keep an eye on things for you. You'd be suprised how the problem disappears. I'm guessing it may have been some person having a fling with a married person trying to find a secluded location. Shame on you for interupting their romantic interlude.:-> Never done that and won't do it again either. :-O Unless I was in my twenties again.LOL
